Who is Justice J B Pardiwala?

  • Jamshed Burjor Pardiwala was born in Mumbai on 12th August 1965 and completed his law degree from K.M. Law College, Valsad (Gujarat) in 1988. He was part of the Constitution bench which upheld the validity of 103rd Constitutional Amendment Act, 2019.

How was the Career Journey of Justice J B Pardiwala?

  • He did his schooling from St. Joseph's E. T. High School, Valsad.
  • He completed his graduation from J.P. Arts College, Valsad in 1985 and LLB from K.M. Law College, Valsad in 1988.
  • He started practice in 1989 at Valsad and joined the bar at Gujarat High Court in 1990.
  • He was born in the family of Lawyers.
    • His Great Grandfather Shri Navrojji Bhikhaji Pardiwala started practice in 1894 at Valsad.
    • Grandfather Shri Cawasji Navrojji Pardiwala started practice in 1929 at Valsad.
    • Father Shri Burjor Cawasji Pardiwala started practice in 1955 at Valsad. He was also appointed as Speaker of 7th Gujarat Legislative Assembly from December 1989 to March 1990.
  • He was elected as a member of the Bar Council of Gujarat from 1994 to 2000.
  • He also worked as a member of Gujarat High Court Legal Services Authority.
  • He was appointed as Standing Counsel for the High Court of Gujarat and its subordinate Courts in 2002.
  • He was elevated as an Additional Judge of Gujarat High Court on 17th February 2011. And appointed as permanent judge on 28th January 2013.
  • He mainly adjudicated matters related to criminal & civil law, services and indirect taxation.
  • He was appointed as the Judge of Supreme Court on 09th February 2022.

What are the Notable Judgments of Justice J B Pardiwala?

  • Suo Moto v. State of Gujarat (2020):
    • In this case the Gujarat High Court took suo moto cognizance in 2020 during Covid-19 for the protection of migrant workers and for the management in the state hospitals.
    • The bench also consisted of Justice Ilesh J. Vora and held that the Covid 19 crisis is a fundamentally human crisis and hence, human life must be prioritized over everything else.
    • The State Government shall ensure that the migrant workers do not have to face further difficulties for the purpose of travelling to their native.
  • Janhit Abhiyan v. Union of India (2022):
    • In this case the constitutional validity of 103rd Constitutional Amendment Act, 2019 was challenged.
    • He was part of the Constitution bench and by 3:2 majority, the bench upheld the validity of 103rd Constitutional Amendment. In the majority Justice Bela M Trivedi, Justice Dinesh Maheswari and Justice J B Pardiwala were included.
    • The bench held that the amendment related to EWS reservation (10%) is constitutionally valid.
  • Dr. Jaya Thakur v. Government of India (2023):
    • The petition was filed under Article 32 of Constitution of India, 1950. The petition was related with female menstrual hygiene.
    • The three-Judge bench comprised of Chief Justice Dr. DY Chandrachud, Justice J.B. Pardiwala and Justice Manoj Misra.
    • The Supreme Court directed all States and Union Territories must submit their menstrual hygiene management strategies and plans which are being executed either with the help of funds provided by the Central Government or through their own funds to the Mission Steering Group of the National Health Mission within a period of four weeks.
